GENERAL TERMS

1. **Eligibility:** Members/Spa Guests must be at least 18 years old and are required to fully agree to our non-negotiable terms and conditions.

2. **Identification:** Upon joining, you are obligated to provide a recent photograph for identification purposes using our membership
software.

3. **Property Liability:** We hold no responsibility whatsoever for any loss, damage, or theft of property, vehicles, or items left in vehicles on our site, including the car park.

4. **Club Closure:** We possess the unequivocal authority to, on required occasions, close all or part of Energise Pentney Health Club. In such instances, you shall not be entitled to any refund. This includes the Outdoor Vitality Pool during inclement weather, e.g. high winds and/or when access is unsafe.

5. **Schedule Changes:** We retain the unchallenged right to adjust our Opening Hours and Pool Timetable, with notifications sent via email and our website.

6. **Force Majeure:** We bear no responsibility for any failure to meet our obligations due to events beyond our control.

7. **Changes to Terms:** We may, at our sole discretion, make reasonable changes to these Terms and Conditions, which shall be provided with any offer or agreement, thereby potentially superseding these terms.

8. **Management Discretion:** The management reserves the absolute right to refuse service or Membership and to cancel Memberships.

HEALTH & SAFETY

Adherence to all safety signage and instructions from staff is mandatory at all times.

1. **Fitness Assessment: ** If you have concerns about your itness or ability to exercise, you are compelled to consult a Doctor before joining. You must complete and sign a Medical Questionnaire upon joining and promptly inform us of any relevant conditions. A complimentary induction is extended upon joining, and by declining this, you are asserting your competence with the use of our equipment and facility.

2. **Supervision:** Our facilities, including the Swimming Pool and Outdoor Heated Vitality Pool, are not continuously supervised. If you have a medical condition that may impact your safety, we strongly advise you to be accompanied on-site.

3. **Equipment Use:** You bear the sole responsibility for using our facilities correctly and strictly adhering to posted instructions. We strongly recommend that all members complete a gym induction.

4. **Personal Trainers:** Personal Trainers at Energise Pentney Health Club operate as self-employed individuals, and we shall not be held accountable for any services they provide, advice they dispense, or any payments made to them.

BEHAVIOR AND USE OF THE FACILITIES

1. **Etiquette:** Members are duty-bound to adhere unfailingly to our 'Gym, Spa, and Pool etiquettes,' as prominently displayed within the club and on our website and reiterated below. Policy changes shall be duly communicated via email.

2. **Zero Tolerance:** We retain the unassailable right to terminate memberships for behaviour that is deemed unreasonable or offensive, including but not limited to discriminatory or anti-social actions. Incidents of such nature must be reported promptly to the front desk or by email to: reception@energise-pentney.co.uk.

3. **Use at Own Risk:** The use of the pool, gym, and spa is solely at your own risk.

4. **Management Discretion:** The management reserves the absolute right to refuse admission or demand your departure if deemed necessary.

Gym Terms and Conditions of Use

To guarantee a positive and respectful gym experience for all members, strict adherence to the following gym etiquette guidelines is not negotiable, particularly regarding filming or recording:

1. **Sanitary Practices:** Impeccable personal hygiene, including the use of clean workout attire, is mandatory. Always thoroughly wipe down equipment before and after use, using the sanitizing stations provided.

2. **Time Management:** Meticulous attention to your workout duration is obligatory, especially during peak hours, to afford other Members access to equipment. Sharing equipment is not a choice but a requirement. Allowing
others to "work in" between sets, if necessary, is a non-negotiable practice.

3. **Volume Control:** Noise levels must be maintained at an absolute minimum. The use of headphones for music is compulsory, and any loud conversations that may disrupt fellow members will not be tolerated.

4. **Re-Racking Weights:** After using free weights or weight machines, immediate return to their designated storage areas is mandatory. This includes barbells, dumbbells, and weight plates. Do not drop weights to the floor.

5. **Mobile Phones/Devices:** Limiting phone usage to essential calls or workout-related activities is expected. Please step away from equipment when using your phone to prevent any unnecessary delays.

6. **Filming and Recording:** In the event that you wish to film or record your workout for personal use or social media sharing, stringent adherence to the following guidelines is imperative:

7. **Respect Privacy:** Capturing the image of other gym-goers in your footage without their explicit consent is strictly prohibited. The privacy of others must be respected, and no one should be featured in your content without their express approval.

8. **Safety First:** Under no circumstances should safety be compromised for the sake of recording. Your primary focus must remain on maintaining proper form and exercise technique.

9. **Considerate Filming:** A location that does not obstruct the flow of traffic or disturb others must be sought for filming. Setting up cameras or equipment in narrow pathways or busy areas is strictly prohibited.

10. **Equipment Accessibility:** Equipment may not, under any circumstances, be reserved or occupied solely for filming purposes. Others must have the ability to use it when you are not actively exercising.

11. **Personal Space:** Respect for the personal space of others during exercise is non-negotiable. Crowding or standing too close to someone during their workout is strictly prohibited.

12. **Cleanliness:** The provided sanitizing stations must be used unfailingly to wipe down equipment before and after use, including any equipment employed for filming.

13. **Gym Floor Safety:** Activities such as running, horseplay, or any actions that could compromise your safety or that of others are strictly prohibited.

14. **Proper Form:** The primacy of proper exercise form and technique cannot be overemphasized in injury prevention. If in doubt, seek guidance from gym staff or contemplate a personal training session.

15. **Hydration and Nutrition:** While staying hydrated during your workout is crucial, the consumption of food or drinks on the gym floor, except for water in a sealed container, is strictly prohibited.

16. **Sharing the Space:** An acute awareness of your surroundings is demanded, with courtesy in mind when moving around the gym. The passage of others must be facilitated, and blocking pathways is prohibited.

17. **Feedback:** Any identified equipment issues must be immediately conveyed to staff.

By adhering to these gym etiquette guidelines, especially in relation to filming or recording, you are actively contributing to a welcoming and harmonious environment for all members, thereby enhancing everyone's
fitness journey. We extend our gratitude for your unwavering cooperation and consideration.

Pool Terms and Conditions of Use

1. **Children's Supervision:** Children under 18 years old must always be accompanied by a parent or a trusted adult, aged 18 or older.

2. **Supervision Ratio:** A strict ratio of one adult (aged 18 years or older) for every two children is enforced to ensure constant supervision.

3. **Appropriate Attire:** To maintain hygiene and safety standards, suitable swimwear that fully covers the groin and buttock area must be worn when using the pool and surrounding areas. Swimwear that may compromise water quality, safety, or the comfort of other pool users, such as street clothes, gym clothes, or underwear, is strictly forbidden.

4. **Pre-Swim Shower:** A mandatory shower to eliminate contaminants and contribute to a clean and safe swimming environment must be taken before entering the pool.

5. **Water Depth Restrictions:** Individuals classified as weak or non-swimmers must restrict their pool usage to areas with a water depth less than 1.5 meters and remain under constant adult supervision.

You are unequivocally prohibited from bringing glass containers, food, or beverages, other than drinks in a sealed container or closed lid cup, into the pool facilities.

SPA FACILITY TERMS AND CONDITIONS

To ensure a relaxing and safe experience for all users, please read and adhere to the following Terms and Conditions:

*1. Health and Safety:*

a. Prior to using the spa facilities, a consultation with a medical professional is strongly recommended, especially if you have any pre-existing medical conditions, are pregnant, or have any reservations regarding your health or well-being in
relation to spa treatments or facility usage.

b. You are required to shower before entering the spa facilities in order to maintain a clean and hygienic environment for all users.

c. The use of the spa facilities is exclusively at your own risk. Utmost caution and care must be exercised while using them, with a keen awareness of your own physical limitations.

d. Children under 18 years old are categorically forbidden from entering or using the spa facilities including the Outdoor Heated Vitality Pool and surrounding area.

*2. Clothing and Attire:*

a. Only suitable swimwear, providing full coverage of the groin and buttock area, may be worn in the spa facilities. Nudity is prohibited.

b. The removal of all outdoor shoes before entering the spa areas is obligatory. Clean footwear, such as flip-flops or sliders, must be used for safety and hygiene.

c. Under no circumstances are glass containers, food, or beverages permitted within the spa facilities, other than drinks in a sealed container, closed lid cup, or cup from the water dispenser provided.

*4. Conduct:*

a. The maintenance of a serene and harmonious atmosphere within the spa areas is a requirement. Loud conversations and disruptive behaviour are strictly prohibited.

b. Smoking, including vaping, and alcohol consumption within the premises are expressly forbidden. Drug use is forbidden across the site. Smoking, including vaping, is permitted within the designated Smoking Area.

c. The privacy and comfort of fellow spa guests must be respected. Conversations and interactions must be respectful and courteous.

d. The use of mobile phones/electronic devise within the spa areas, inclusive of phone conversations and calls, is strongly discouraged. Mobile phones are to be set to silent mode.

*5. Time Limits:*

a. To guarantee access for all guests, the imposition of time limits for the utilisation of certain spa facilities, particularly during peak periods, is a non-negotiable requirement. A full compliance with these limits is demanded, coupled with
cooperation with our staff.

*6. Maintenance and Safety:*

a. We reserve the to temporarily close specific spa facilities if required, e.g. for maintenance, cleaning, or safety considerations. Such instances shall be marked by your understanding and are not eligible for a refund. There may be occasions when the spa facilities are forced to close due to circumstances beyond our control. Reasonable efforts shall be made to provide advance notice when possible, but it must be unequivocally understood that such closures shall not
be deemed eligible for a refund.

*7. Reporting Issues:*

a. Any encounters with issues, concerns related to cleanliness, or requirements for assistance should be immediately brought to the attention of staff. We are at your disposal to ensure your comfort and safety.

*8. Inappropriate Behaviour:*

a. Inappropriate behaviour, including harassment, heavy petting, or the use of foul or abusive language, is forbidden. Any such behaviour shall warrant immediate expulsion from the site.

By using our Spa facilities, you hereby irrevocably agree to abide by these Terms and Conditions. We are resolutely committed to providing a tranquil and rejuvenating experience, and your unwavering cooperation is pivotal to ensuring that all guests may derive the utmost enjoyment from the Spa. We extend our gratitude for your compliance, and trust that your visit will be characterised by relaxation and enjoyment.


BOOKING PROCESS

a. To book Spa treatments or Spa experiences, please contact Reception or use our website to make a booking.

b. All spa bookings are subject to availability.


Cancellation policy - spa experiences + treatments

To protect therapist time and ensure fair availability for all guests, the following terms apply to all bookings for treatments, Swim & Spa Passes and Essential, Signature & Luxury Spa Experiences. In all circumstances of cancellation please notify us by email or phone as soon as possible.

Cancellations made more than 7 days before the appointment

A full refund is available.

Cancellations made less than 7 days before the appointment

Non-refundable unless Cancellation Protection was purchased within the required timeframe.

No-shows

All no-shows are fully chargeable, regardless of Cancellation Protection.

Cancellation Protection

Cancellation Protection offers full flexibility for guests who need it. It allows you to cancel for any reason, up until your appointment start time, and receive a full refund of your booking cost (or reinstatement of voucher value, if using a voucher).

To qualify, it must be added:

-  Within 48 hours of making the booking, and

- No later than 7 days before the appointment date.

The Cancellation Protection fee is non-refundable and not subject to any discount.

Gift Vouchers

Gift vouchers are non-refundable and hold no cash value. They may be redeemed for treatments within their validity period and can be booked online or over the phone.

Voucher Bookings – Cancellation Rules

Voucher bookings follow the same cancellation terms as standard treatment bookings:

- More than 7 days’ notice: voucher reinstated for re-booking.

- Less than 7 days’ notice: voucher is redeemed in full and no alternative date is offered unless Cancellation Protection was added.

- No-shows: voucher is fully redeemed.

Voucher bookings may add Cancellation Protection on the same terms as paid bookings (within 48 hours of booking and no later than 7 days before the appointment).

Voucher Extension (Strict Limits Apply)

To keep things fair and compliant with accounting rules:

  • A voucher may be extended once only.
  • The extension must be purchased within 1 month of the voucher’s expiry date (final 30 days).
  • Vouchers that expired more than 30 days ago cannot be extended.
  • A single extension provides an extra 3 months from the original expiry date.
  • Extension fee: £15.
